Terms & Conditions of Sale

1. Scope

These Terms govern all sales concluded through steakhouse25.com between Kilometro 25 di Ciacci Giovanni & C. S.a.s., Via Italo Svevo 39, 61036 Colli al Metauro (PU), Italy — VAT/Tax code IT02621710413, REA PS-196515, PEC km25@pec.it, legal representative Giovanni Ciacci (“Seller”, “we”) and the customer (“you”). By placing an order you accept these Terms in full.

2. Products, Prices & Currency

All products are fresh, chilled, frozen or cured meat products, cut to order. Images are illustrative; being natural products, exact appearance and weight may vary within a ±5% tolerance on the stated weight.

Prices are displayed and charged in Euro (EUR) and include Italian VAT where applicable. Shipping costs are shown before payment. For deliveries outside the EU, import duties and taxes are not included and are your responsibility (see §8).

3. Order Process & Contract Formation

The contract is concluded when we send you the order confirmation after successful payment. We may refuse orders in case of product unavailability, payment issues, or delivery destinations we cannot serve under food-safety and import rules. In such cases any amount paid is refunded in full.

4. Payment

Payments are processed by Stripe (credit/debit cards, Apple Pay, Google Pay, Link). Card data is handled exclusively by the payment provider on PCI-DSS certified infrastructure and never touches our servers.

5. Shipping & Risk Transfer

We ship via express courier (DHL Express / UPS) in insulated, temperature-controlled packaging, Monday to Thursday. Estimated transit: Italy next day; EU 24–48h; UK/CH/NO 48–72h; extra-EU 48–96h. Risk transfers to you upon delivery. If delivery fails due to an incorrect address or repeated absence, and the goods perish as a result, we cannot issue a refund; the courier attempts delivery twice and holds the parcel at a pickup point within the safe cold-chain window.

6. Right of Withdrawal — Exclusion for Perishable Goods

IMPORTANT: Pursuant to Art. 59(1)(d) of Directive 2011/83/EU and Art. 59, lett. d) of the Italian Consumer Code (D.Lgs. 206/2005), the right of withdrawal does NOT apply to goods that are liable to deteriorate or expire rapidly, such as fresh and chilled meat. By accepting these Terms at checkout you expressly acknowledge this exclusion.

This exclusion does not affect your legal guarantee of conformity nor our voluntary Freshness Guarantee (§7).

7. Guarantees

Legal guarantee: as a consumer you benefit from the legal guarantee of conformity under Arts. 128–135 of the Italian Consumer Code.

Freshness Guarantee (voluntary): if your order arrives with a compromised cold chain, damaged packaging or wrong items, we replace or refund it in full, provided you notify us with photos within 24 hours of delivery at info@steakhouse25.com.

8. Customs & Import Duties

For deliveries outside the European Union, you are the importer of record. Import duties, taxes and any veterinary inspection fees are your sole responsibility. Some countries prohibit or restrict meat imports; where we cannot legally ship, we will cancel and refund the order.

9. Limitation of Liability & Force Majeure

Nothing in these Terms limits liability for gross negligence, willful misconduct, or personal injury. We are not liable for delays or failures caused by events beyond reasonable control (extreme weather, carrier disruptions, customs holds), though the Freshness Guarantee continues to apply to the condition of the goods.

10. Governing Law & Jurisdiction

These Terms are governed by Italian law. For consumers, mandatory protections of the country of residence remain unaffected, and the competent court is that of the consumer’s residence. EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
